1. Provider

This platform is operated by Enanza Ventures GmbH, Martin-Luther-Str. 14, D-20459 Hamburg, represented by Managing Director Stephan Akrong.

2. Subject Matter and Scope of Service

Kreativbuch provides a digital service for creating personalized stories and illustrations. The specific scope of services is defined by the features visible on the platform.

Text and image generation is performed using AI systems. Generated content is automated output and must be reviewed by users before use.

3. Registration and User Account

Certain features require a user account. Access credentials must be kept confidential and must not be shared with third parties.

Users are responsible for activities performed under their account to the extent they are attributable to them.

4. Contract Formation

The presentation of services on this platform does not constitute a legally binding offer. A contract is only concluded through explicit confirmation or provision of the service.

5. Prices and Payment

The prices shown on the website at the time of order or booking apply.

If paid services are offered, payments are processed via integrated payment service providers under their own terms.

6. Usage Rights and User Content

Users are responsible for the content they submit and confirm that no third-party rights are infringed.

Users must not submit, upload, or use for generation any content that infringes copyrights, trademarks, design rights, name rights, personality rights, or any other third-party rights. This applies in particular to protected characters, texts, song lyrics, images, logos, or other source material from films, series, books, games, or brands, unless the user has explicit permission to use such material.

Content generated by the service may be used within the usage options provided on the platform.

By each submission, users represent that they hold all required rights, consents, and licenses. Users shall indemnify and hold Enanza Ventures GmbH harmless from third-party claims based on infringements for which the user is responsible, including reasonable legal defense costs. We may block or remove allegedly infringing content and temporarily or permanently suspend user accounts in case of repeated or material violations.

7. Availability and Technical Infrastructure

We strive to keep the service continuously available, but do not guarantee uninterrupted availability at all times.

To provide the service, we rely on technical providers and infrastructure partners (including hosting with Hetzner).

8. Liability

Statutory liability provisions apply. To the extent legally permitted, liability for slight negligence is limited to essential contractual obligations.

9. Data Protection

Information on personal data processing, the services used (including PostHog and Google Analytics), legal bases, and data subject rights is provided in the Privacy Policy.

10. Final Provisions

German law applies. Where legally permissible, place of jurisdiction is Hamburg.
